Privacy statement
This statement describes how Fedasil processes personal data in the context of the use of the website www.voluntaryreturn.be, for which Fedasil acts as data controller.
Fedasil processes your personal data in accordance with the General Data Protection Regulation, better known as “GDPR”, and the law of 30 July 2018 concerning the protection of natural persons with regard to the processing of personal data.
The purpose of this privacy statement is to provide greater transparency regarding which personal data of you are being processed, the purposes for which the data are processed and what rights you have.
Data controller
Fedasil, the Federal Agency for the Reception of Asylum Seekers, (Kartuizersstraat 21 - 1000 Brussels), represented by the Director-General, is the controller responsible for the processing of the personal data processed in the context of the website www.voluntaryreturn.be.

The data protection officer is the contact person for any questions you may have regarding the processing of your data and regarding the exercising of your rights under the GDPR, the answers to which are not addressed in this privacy statement.

Why does Fedasil process your data?
Use of personal data via the contact form and e-mail:
When you provide personal data to Fedasil (such as your name, e-mail address and telephone number) via the contact form on our website or by e-mail, we use this data solely to provide you with information about voluntary return and to process your order for communication materials. These data processing operations are conducted with your consent.
Security logs:
In addition, we record IP logs of website visitors in order to protect our website from threats such as DDoS attacks and hacking attempts. This processing is carried out on the basis of the legal obligation incumbent on Fedasil with regard to cybersecurity.
How are your data secured?
Fedasil takes appropriate technical and organisational security measures to protect personal data against accidental or unlawful deletion, accidental loss, unauthorised changes, unauthorised disclosure or access, misuse and any other unlawful form of processing of the personal data in our possession.
Who are the recipients of your data?
Your data will not be transferred to third countries or to international organisations.
The processing of personal data is done by Fedasil employees. These employees are bound by a duty of discretion in accordance with Fedasil’s code of conduct. Some employees, such as doctors, are additionally bound by legal professional confidentiality. We make every effort to continually train our employees about the importance of privacy and data protection.
Fedasil employees use automated information systems that were purchased from external service providers.
In addition to IT services, Fedasil also relies on various other processors for human resources management, legal assistance and related support services. These external parties act exclusively on behalf of and under the authority of Fedasil, in accordance with the provisions of the processing agreements and applicable personal data protection legislation.
How long do we keep your personal data?
Fedasil holds on to personal data in accordance with the statutory retention periods and the internal archiving selection lists. Personal data are not kept longer than necessary. After the expiry of these retention periods, personal data will be destroyed.
Your rights
Depending on the processing and the legal basis, you have a number of options that allow you to maintain control over your personal data:

Right to inspect and to obtain a copy: you have the right to inspect your personal data processed by Fedasil and to obtain a free copy of it.

Right of rectification: you have the right to have incorrect personal data relating to you corrected without undue delay. Having regard to the purposes of the processing, you have the right to have incomplete personal data completed.

Right to object: in a number of cases, you have the right at any time, due to reasons related to your specific situation, to object to the processing of personal data relating to you.

Right to restrict processing: in a number of cases, you have the right to have the processing of your personal data restricted.

Right to data erasure: in a number of cases, you have the right to have your personal data erased without undue delay.

Right to data portability of your personal data: in a number of cases, you have the right to receive your personal data which you have provided to Fedasil, in a structured, commonly used and machine-readable format and to transfer it to another data controller.

Right to withdraw your consent: where the processing of personal data is based on your consent, you have the right to withdraw that consent.

You can exercise these rights with Fedasil by addressing your questions to Fedasil via privacy@fedasil.be of by using the contact form. If you do not have access to a computer, you can also send your request by letter for the attention of our data protection officer at the following address:

We remind you that we may take reasonable steps to verify your identity in order to be sure that no one else is trying to exercise your rights.
In principle, your request will be processed within one month. If your request is complex or we need to process a large number of requests, this period may be extended by a further two months.
